The Following Terms and Conditions relate to transactions made on this website or over the phone between WizKidPC ("WizKidPC", "Digital Dimensions" "We", "Us"), and the customer ("you").
These terms are not valid for Purchase Orders. See Terms and Conditions for Purchase Orders.
By purchasing or accepting delivery of any product delivered from WizKidPC you agree to be bound by the terms and conditions listed below even if you have not read them. You and WizKidPC agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and WizKidPC. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from WizKidPC.
WizKidPC SATISFACTION GUARANTEE - WizKidPC offers our customers a 30-day or 14-day satisfaction replacement or refund guarantee on all purchases, with the exception of special, discontinued or discounted items. Further, all returns are subject to the Product Return Procedures as stated here.
30 Day Money Back Guarantee
Our 30 day money back and return policy is simple, if you are not 100% satisfied with the system you receive then you have 30 days starting from the shipping date to return it. We must be contacted within the 30 day period to supply you with a Return Merchandise Authorization (RMA). Return shipments must be prepaid and fully insured by the customer and include all components, manuals, and packaging sent. Customer must take measures to ensure that products are packaged properly in accordance to UPS packaging guidelines, so as to not get damaged during shipping. Customer will be credited back via original purchase method with a full refund minus the following: shipping cost, software (including Operating System), and missing items. A 20% restocking fee may apply. Damaged or defaced components may only be returned for a refund under special approval.
14 Day Money Back Guarantee
Our 14 day money back and return policy is simple, if you are not 100% satisfied with the system you receive then you have 14 days starting from the shipping date to return it. ITEMS NOT COVERED:
There is no replacement or refund guarantee of any kind for any retail package processors, customized orders, custom kits, shipping costs, or software (including Operating System). Items that are lost or stolen cannot be replaced or refunded, except under special circumstances at the sole discretion of WizKidPC. There is likewise no replacement or refund guarantee covering any product that is affected by any "Year 20xx" compliance problem.
Products sold by WizKidPC that are not manufactured by WizKidPC or Digital Dimensions may, however, be covered by each manufacturer's warranty, service, and support policy (if any). WizKidPC assigns and passes through to the Customer any warranty of the manufacturer, and Customer acknowledges that it shall have recourse only under such warranties and only against the manufacturer of the products. WIZKIDPC MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THESE PRODUCTS EXCEPT THOSE STATED IN THIS DOCUMENT.
For Parts and Labor Limited Warranties purchased from WizKidPC for computers or systems that WizKidPC manufactures, WizKidPC warrants the original purchaser that all components are free from defects and workmanship for the period of the purchased warranty, (normally 1,2, or 3 years) which begins upon receipt of delivery. Accessories not installed by WizKidPC are not covered by this warranty. Parts sent as a customer supplied item, not purchased directly through WizKidPC, or special request purchase items not carried in our catalog will not be covered. Other exclusions of this warranty include damage via shipment; damages caused by fire, fluids, impacts, lightning, inadequate electrical power usage, power surges, or natural disasters; damages occurred by user modifications or tampering, improper installation, maintenance, misuse, or neglect; damages caused by improper environment, repair, adjustment, or installation of components and/or software not performed by WizKidPC. Valid warranties will have defective parts replaced with the same or equivalent part. If the customer requests different parts then they may be required to purchase them at cost.
WIZKIDPC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE OF PERFORMANCE.
LIMITATION OF LIABILITY
IN ALL CIRCUMSTANCES WIZKIDPC MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. WIZKIDPC SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. WIZKIDPC SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, LOSS OF INFORMATION, DAMAGE TO EXTERNAL DEVICES, ACCESSORIES, OR PROPERTY, OR LOSS OF PROFIT RESULTING FROM ANY OF THE ABOVE, WHETHER OR NOT WIZKIDPC IS APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
GENERAL TERMS AND CONDITIONS
Payment Terms; Orders:
An order is not binding upon WizKidPC or Digital Dimensions Inc. until it is accepted; WizKidPC must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with WizKidPC. You agree to pay the amount(s) due as specified on the invoice.
Your total cost for purchase of any product will include shipping and handling charges shown on the WizKidPC invoice.
Title; Risk of Loss:
WizKidPC will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) -- excepting software-- and risk of loss passes to the Customer upon delivery to the carrier. WizKidPC reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow WizKidPC to sign appropriate documents on Customer's behalf to permit WizKidPC to protect its purchase money security interest. Title to software will remain with the licensor(s). All software is provided subject to the license agreement of the software maker. Customer agrees to be bound by any software license agreement once the seal on the package is broken. WizKidPC will advise Customer of estimated shipping dates, but WizKidPC will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.
Governing Law and Jurisdiction:
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between WizKidPC and Customer shall be governed by the laws of the State of Oklahoma, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. WizKidPC and Customer consent to the exclusive jurisdiction and the venue of the State Courts of the State of WizKidPC to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against WizKidPC that is more than one year after the date of the applicable invoice.
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Oklahoma law.
The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.
These terms and conditions, together with the GlaxyTron's invoice respecting the products ordered by Customer, are the complete and exclusive agreement between WizKidPC and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between WizKidPC and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
We offer both online and toll free purchasing via credit card. We also except online checks and direct deposit transactions using PayPal.
Pricing and Availability:
Prices, services and availability of products are subject to change at any time and without notice. We try to offer products and services at a reasonable market price. Prices on this web site are current in real time per session. Price quotes obtained from this web site and saved, copied or cached are not necessarily valid. Since the computer industry is constantly and rapidly changing we take every effort to keep up with these changes.
Orders usually ship with 72 hours, but may take as long as 30 days depending on available of products or parts. Because every machine is custom built to order and we have a high standard of quality that must be achieved before shipping to our customers, orders can take longer. (We would rather take more time to get it right then send a customer an unsatisfactory system.) Orders can take longer to processes depending on availability of parts and/or the number of orders to fill. Prices can change at any time and schedules are subject to terms and conditions of the parcel company.
If an item is damaged or lost during the original shipment to the customer, WizKidPC Inc may replace the item with an identical product at no cost to the customer. Replacement may be preceded by an investigation by the UPS claims department. It is the customer's responsibility to ensure that their delivery has not been damaged before they sign and accept the package(s). While WizKidPC Inc will, in most cases, pay for the item to be replaced at our sole discretion, we do not accept any liability on behalf of UPS, USPS, FedEx, or any other courier/delivery service, and may, at our discretion, choose not to replace or refund an item that has been lost or damaged by said courier/delivery service. Shipping Costs are not refundable under any circumstances.
